License Suspension

If you have been charged with a Massachusetts OUI/DUI/DWI offense, you may be wondering about the amount of time your license will be suspended or revoked. The laws are complicated. In addition to the suspensions resulting from convictions and admissions, there are suspension periods for refusing the breath test or posting a reading of .08 or greater. Under-21 drivers have additional suspension penalties. If you are charged with a second, third, fourth or subsequent OUI, your license loss will be greater.

The laws and regulations regarding your right to operate a motor vehicle in many cases operate separately from the Registry of Motor Vehicles (RMV). This means that the judges may tell you they have no say over your license loss, and refer you to the RMV. The OUI lawyers at Bellotti Law Group, know the most effective methods for dealing with RMV regulations.

For example, a common misconception is that you are entitled to a so-called “work” or “hardship” license. This is not the case. However, you may be able to request one before your suspension period ends. It is critical you make the right decisions and maximize your eligibility these 12-hour licenses, which are issued through the discretion of the hearing officers at the RMV.
