Heavy Equipment Failures

Accidents due to heavy equipment failure frequently result when its use, design, and manufacture do not receive adequate attention. Such accidents may lead to death and injuries including head injuries, brain damage, permanent disfigurement, serious fractures, spinal cord injuries, and paralysis.

Individuals who work in areas of construction must use heavy equipment, such as cranes, forklifts, bulldozers, backhoes, loaders, trucks, tractors, bobcats, and lifts in order to fulfill their job requirements. Their safety depends upon the correct design, production, and use of such highly dangerous heavy equipment.

In order to ensure safety, operators of heavy equipment must be properly and adequately trained and licenses. Furthermore, the equipment itself must be properly maintained. When the equipment is not maintained up to standards established to ensure the safety of operators and others who work on construction sites, there may be detrimental health results.

Occupational Safety And Health Administration (OSHA)

There are strict OSHA regulations as to how heavy machinery is supposed to be maintained and operated to ensure the safety of all individuals involved in its use and surrounding. An injured worker may take action against responsible parties at a construction site when they have acted negligently and failed to follow OSHA regulations.

OSHA regulates heavy equipment by determining who can, and cannot, operate heavy machinery or tools. Employees are prohibited from operating heavy equipment unless they have the proper training required. OSHA’s regulation goes so far as to say that employees who are not granted permission to operate heavy equipment are prohibited from even pressing the equipment’s start button. The reasoning for this is that due to the dangerous nature of heavy equipment, like concrete mixers, masonry saws and bulldozers, ensuring the proper protection of employees can reduce accidents, injuries and fatalities.

Heavy equipment accidents are often the result of the following:

  • Crane failure
  • Road construction accidents
  • Machinery failures
  • Forklift accidents
  • Inadequate safety equipment
  • Inadequate training for use of the product
  • Bulldozer accidents

Common types of heavy machinery injuries include:

  • Paralysis
  • Spinal cord injuries
  • Closed head trauma
  • Hand-arm vibration syndrome
  • Air embolism
  • Silicosis

Personal Injury Claims

Workers’ compensation does not provide benefits for pain and suffering, as well as consequential damages. When a heavy equipment accident is caused by another party, other than the employer or a co-worker, a personal injury claim may be filed against the negligent party. These are called third-party work accident claims because they are filed against a third party (other than the worker and the employer). Such claims may be filed against persons or companies including equipment manufacturers or others involved in the defective design and or production of the product.

If you or a loved one believe that you have been harmed due to heavy equipment failures, contact the Boston construction accident attorneys at Bellotti Law Group, P.C. today at 617-225-2100 to discuss your options.
